TERMS & CONDITIONS

By planning travel with My Path Unwinding Travel, LLC (“we/us/our”, “Agency”) and our travel advisors , you agree to be bound by these Terms & Conditions. You (“you/your”, “Client”) acknowledge that My Path Unwinding Travel acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service providers (“Suppliers”) and that My Path Unwinding Travel is not the source or provider of any travel services.   These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to My Path Unwinding Travel.

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with My Path Unwinding Travel. You agree to be financially responsible for all of your travel bookings made on behalf of yourself and any member of your traveling party and warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with us and our Suppliers, and acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.

My Path Unwinding Travel accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through My Path Unwinding Travel, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved. We are not liable or responsible for any travel arrangements made independently.

RESERVATIONS & PAYMENT


You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through My Path Unwinding Travel. By submitting a payment authorization form to us, you agree to allow us to use your payment method to purchase travel products from our Suppliers on your behalf.

Excepting in cases of fraud, you agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of My Path Unwinding Travel or its suppliers, including cancellations or changes of itinerary or arrangements for reasons beyond the control of us or our suppliers. If you attempt to chargeback, reverse or recollect a previously authorized trip payment, we reserve the right to collect all additional costs, fees and expenses associated with such chargeback, reversal or recollection, including, without limitation, attorney fees.

All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking and/or our group contract agreements.  You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations. In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking.

All cancellation requests must be sent to us in writing. As a result of cancellation or changes to confirmed bookings,  third-party Supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund, if any.

TRAVEL DOCUMENTATION

Travelers are responsible to confirm current entry and exit requirements and to obtain the necessary travel documentation based on the country of origin, destination, and stops in any additional countries. Minors of age 17 and under traveling alone or with a single parent may be required to have additional documentation.

NO REFUND will be issued for any costs or losses incurred as a result of Traveler’s failure to obtain or provide required travel documentation

Client consents to and requests the use of the Suppliers and agrees not to hold My Path Unwinding Travel responsible should any of these Suppliers: 1) fail to provide the travel services Client has purchased;  2)  fail to comply with any applicable law; 3) engage in any act or omission that causes Client any sort of injury, damage, delay or inconvenience; 4) change or modify any portion of the itinerary, including but not limited to airline, routing, ports of call, or scheduling; or 5) fail to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers, and we have no liability for recommending a future trip credit in lieu of a refund.

RISKS OF TRAVEL

In General: We have no special knowledge regarding unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which Client may travel, and we have no special knowledge of the suitability for disabled persons of any portion of Client’s trip. For information concerning possible dangers at destinations, we recommend reviewing the Travel Warnings Section of the U.S. State Department Website or calling (202) 647-5225. To review the Travel Warnings Section of the U.S. State Department Website, go to: http://www.travel.state.gov/, click on “Find International travel Information” then click on “Country Information”, and fill in the name of the destination country.  For medical information, we recommend contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel and click on “Destinations”. Client assumes full and complete responsibility for checking and verifying any passport, visa, vaccination, or other entry requirements of Client’s destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). CLIENT HEREBY RELEASES US FROM ALL CLAIMS ARISING OUT OF ANY PROBLEM COVERED IN THIS PARAGRAPH.

COVID Risks of Travel: Client agrees that it is Client’s personal decision to travel, and Client is doing so with full knowledge of current travel recommendations and travel restrictions with regard to the risks of COVID-19. We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as health affidavit forms, health screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, we recommend going to IATA’s website at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm. By traveling during the ongoing COVID-19 pandemic, Client acknowledges the contagious nature of COVID-19 and voluntarily assumes all risks related to exposure to COVID-19. CLIENT HEREBY RELEASES US FROM ALL CLAIMS ARISING OUT OF ANY PROBLEM COVERED IN THIS PARAGRAPH.

TRAVEL INSURANCE

My Path Unwinding Travel strongly recommends that each traveler purchase comprehensive travel insurance. If you decline to purchase travel insurance that includes coverage for medical needs while traveling and coverage for travel delays, you assume all personal risk and financial loss if you cancel your travel or incur costs or losses during the course of travel. We cannot guarantee that any insurance provider will approve coverage for a claim made under the insurer’s policy and makes no representations about the extent of coverage for any policy it may offer or quote.

You understand that concerns or fear of pandemics or epidemics are not a covered reason under most travel insurance policies.

Insurance policies may exclude coverage for pandemics and epidemics.

You hold Agency harmless for your election not to purchase travel insurance and for any denial of any claim by any insurer for any reason.

FORCE MAJEUR

My Path Unwinding Travel will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of My Path Unwinding Travel.

In addition, our Suppliers may have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier, pursuant to their policies, although GSC shall use its reasonable efforts to secure reimbursement for you where possible.

LIMITATIONS OF LIABILITY

Because My Path Unwinding Travel acts as agent for suppliers and does not have the right to control the operations of such independent operators and suppliers, you agree that we are not liable for any personal injury or property damage, which may arise out of these services. My Path Unwinding Travel hereby disclaims any liability whether based on contract, tort, strict liability or otherwise, including without limitation liability for any direct, punitive, special consequential, incidental or indirect damages, in connection with the goods or services provided by any supplier booking through us, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligence, willfull acts, omissions or otherwise of such supplier, or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services, their cancellation and refund policies, fuel increases, bankruptcy or cessation of operations and other matters outside of our control, and you exonerate us from any liability with respect to the same.

Any recovery by you from agency will be limited to the amount of commissions or fees actually received by agency for providing booking services to you directly related to such recovery on a case-by-case basis.

Agency’s sole obligations and liabilities are as stated in these terms. All other representations or warranties—express or implied, by statute, law, or otherwise—are excluded.

GENERAL

The laws of the State of North Carolina govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Union County, North Carolina in all disputes arising out of or relating to travel bookings with My Path Unwinding Travel.

If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and Agency with respect to travel bookings made with My Path Unwinding Travel by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and My Path Unwinding Travel with respect to communications with My Path Unwinding Travel. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
